[4e éd. - 2008] Les trois premiers chapitres de cet ouvrage sont consacrés à un aperçu de droit comparé et au contexte constitutionnel au sens large, incluant des aspects de la Convention de sauvegarde des droits de l’Homme et des libertés fondamentales. Après une brève description du Conseil d’Etat, dans la mesure où elle est nécessaire à la compréhension des procédures, les chapitres suivants sont consacrés au contentieux de l’annulation, à sa procédure et aux conséquences des arrêts, au référé, puis au parent pauvre qu’est le contentieux de l’indemnité et aux compétences de pleine juridiction, marginales, sauf pour le contentieux électoral. L’étude des voies de recours clôture l’ouvrage. [5e éd. - 2011] Cet ouvrage correspond à l'enseignement que son auteur dispense depuis 1991 à la Faculté de Droit et de Criminologie de l'Université Libre de Bruxelles, et il tire un large parti de l'expérience qu'il a acquise en tant que magistrat au Conseil d'Etat. Il est conçu en vue de fournir à ses lecteurs les bases historiques et théoriques indispensables à une compréhension en profondeur du contentieux administratif belge, et de donner tant aux étudiants qu'aux praticiens un exposé du droit positif, émaillé, à l'occasion, d'observations critiques. Une de ses options fondamentales est de ne pas isoler le contentieux administratif de son environnement juridique, mais au contraire de l'y plonger chaque fois que cela présente une utilité, de montrer les corrélations avec des questions dont l'étude relève plutôt d'autres branches du droit, dont l'auteur a tenu à montrer qu'elles présentent avec l'objet de son enseignement un lien moins ténu qu'il n'y paraît à première vue. Des aspects de droit constitutionnel y trouvent naturellement une place, mais aussi, occasionnellement, des questions de pur droit civil; dans une Europe qui se construit, le droit européen pointe parfois là ou on l'attend le moins. Les trois premiers chapitres sont consacrés à un aperçu de droit comparé et au contexte constitutionnel au sens large, incluant des aspects de la Convention de sauvegarde des droits de l'Homme et des libertés fondamentales. Après une brève description du Conseil d'Etat, dans la mesure où elle est nécessaire à la compréhension des procédures, les chapitres suivants sont consacrés au contentieux de l'annulation, à sa procédure et aux conséquences des arrêts, au référé, au contentieux de la cassation administrative, qui a acquis de nettes spécificités par rapport au contentieux de l'annulation dont il a été dissocié, puis au parent pauvre qu'est le contentieux de l'indemnité et aux compétences de pleine juridiction, marginales, sauf pour le contentieux électoral. L'étude des voies de recours clôture l'ouvrage. Un aspect a été délibérément omis, non qu'il soit d'importance négligeable, mais parce que les développements qu'il mériterait gonfleraient ce volume dans une mesure hors de proportion avec l'intérêt qu'il présente sur le plan pédagogique: c'est l'emploi des langues dans les procédures devant le Conseil d'Etat.
